Overview

Future of Privacy Forum (FPF) and NASSCOM, India’s largest industry association for the IT-BPM sector, are co-hosting two webinars on the consent regime under India’s new Digital Personal Data Protection Act of 2023 (DPDPA).

A key design feature of the DPDPA is its consent-centric approach. The aim of these webinars is to bring together views and perspectives from a diverse set of experts from regulators, industry, civil society, and the global data privacy community, to explore how these rules can be informed by the experiences in other jurisdictions.

Monday, January 29, 2024: Making Consent Under the DPDPA Scalable

Panel 1: Realizing the ‘Consent Manager’ Model | 6:30 – 7:30 am EST / 12:30-1:30 pm CEST / 5 – 6 pm IST
The DPDPA recognises ‘Consent Managers’ as players involved in intermediate consent management. Parallels are being drawn with the Account Aggregators (AA) that embody India’s approach to open banking. Many expect that the regime for Consent Managers, which is to be defined in rules, will be informed by India’s experience with the AA model. That said, the DPDPA does recognize the potential for ‘Consent Managers’ as a regulatory category to accommodate multiple different models that look to enhance consent.

Panel 2: Operationalizing ‘Verifiable Parental Consent’ in India | 7:40 – 8:40 am EST / 1:40 – 2:40 pm CEST / 5 – 6 pm IST
The DPDPA also necessitates ‘verifiable parental consent’ to process the personal data of children. This appears to be inspired by similar requirements found in the Children’s Online Privacy Protection Act (COPPA) in the United States that is enforced by the Federal Trade Commission. However, the precise scope of application, and manner of operation, of this requirement is also left up to rules to define.

Christina Michelakaki

Policy Counsel for Global Privacy, FPF

Christina Michelakaki is a Policy Counsel for Global Privacy at the Future of Privacy Forum (FPF). She is following global trends in data protection and privacy laws around the world but also focuses on European and national case law, recent academic research, guidelines, and decisions from the European Data Protection Board and national Data Protection Authorities and actively monitors the activity of EU institutions around privacy and data protection, including Communications and Proposals of the European Commission and legislative reports from the European Parliament and the Council of the EU. She has been conducting extensive research on Data Protection by Design and by Default and was one of the principal authors of an FPF Report pertaining to this matter. Her research interests also revolve around fundamental rights and Artificial Intelligence.

Christina has a legal background and holds an LL.M on Information Technology, Media & Communications Law from the London School of Economics (LSE) (2022, London), where she wrote her thesis on Automated decision-making and the “right to an explanation” under the GDPR. She is an EU qualified lawyer and a member of the Thessaloniki Bar Association in Greece.

Malavika Raghavan

Senior Fellow, FPF

Malavika Raghavan is a lawyer working on interdisciplinary research in India, focusing on the impacts of digitization on the lives of lower-income individuals. Her work since 2016 has focused on the regulation and use of personal data in service delivery by the Indian State and private sector actors, often enabled by expansive State-supported technical and regulatory architectures. Malavika founded and led the Future of Finance Initiative for Dvara Research (an Indian think tank) in partnership with the Gates Foundation from 2016 until 2020, anchoring its research agenda and policy advocacy on emerging issues at the intersection of technology, finance, and inclusion.

Research that she led at Dvara Research was cited by the India’s Data Protection Committee in its White Paper as well as its final report with proposals for India’s draft Personal Data Protection Bill, with specific reliance placed on such research on aspects of regulatory design and enforcement. She remains an Advisor on the Initiative’s International Advisory Board, and also serves on the Steering Committees of the Digital Identity Research Initiative (DIRI) at the Indian School of Business, and the Data Governance Network at the IDFC Institute, India. She is a member of the Asian Privacy Scholars Network.

Malavika’s previous experience includes several years with the global law firm Allen & Overy LLP in London (during which time she was seconded to the Financial Markets Law Committee established by the Bank of England) as well as stints with social impact investors Acumen and Big Society Capital. She was a 2018 fellow of the Chevening Financial Services Fellowship at King’s College London, and a 2016 fellow of the On Purpose social enterprise leadership program. Malavika holds an MPhil in Public Policy from the University of Cambridge and a B.A., LL.B.(Hons) degree from the National Academy of Legal Studies and Research (NALSAR), Hyderabad.

Bailey Sanchez

Senior Counsel for Youth & Education Privacy, FPF

Bailey Sanchez is Senior Counsel with the Future of Privacy Forum’s Youth & Education team. Bailey leads the team’s work analyzing legislative proposals that impact children and teens’ online privacy and safety. Bailey seeks to understand legislative and regulatory trends at the intersection of youth and technology and provide resources and expertise to stakeholders navigating the youth privacy landscape. Prior to joining FPF, Bailey was a legal extern at the International Association of Privacy Professionals.

Bailey holds a J.D. from the University of New Hampshire School of Law and a B.A. in Political Science from the University of Central Florida. While at UNH Law, she served as a research assistant to Professor Alexandra Roberts, a legal writing teaching assistant to Professors Jennifer Davis and Rachel Goldwasser, president of the Civic Engagement Society, and a student attorney in UNH Law’s Intellectual Property & Transaction Clinic.
